GOB 'n' GOB Terms & Conditions and User License

These Terms and Conditions and User License cover the download and use of the GOB 'n' GOB game (the “game”) by Little Dreamer Games (“Little Dreamer Games,” “LDG,” “our,” or “us”). By downloading or using GOB 'n' GOB, these terms apply to you – you should make sure therefore that you read them carefully before using the game.

License and usage

LDG hereby grants you a limited, non-exclusive, non-transferable, personal license to use this game on a personal device, downloaded through an appropriate app store for your device, subject to the limits of this license. Except for downloading and installing the game on your personal device for your personal use, you may not copy or modify the game, or any part of the game in any way. You may not attempt to extract the source code of the game, translate the game into other languages or otherwise make derivative works. The game and all the trademarks, copyright, database rights, and other intellectual property rights related to it, belong to LDG.

Data Usage

GOB 'n' GOB collects some information about you and your game play, which is subject to our www.littledreamergames.com/privacy. We display a leaderboard by Meta Username, which you may choose to be any available name. We do not sell your personal information to anyone.

LDG endeavors to ensure that the game is updated regularly, and we may rely on third parties to provide information to us so that we can make it available to you, such as crash report data. Such data is de-identified or aggregated when we use it.

If you’re using the game outside of an area with Wi-Fi on a device capable of using a cellular network for data, please be aware that the game may use data over your cellular network, and depending on your data plan you may be charged for such data. This may include data used for downloading or updating the game. Please check with your provider. In using the game, you accept responsibility for any such charges, including roaming data charges. LDG cannot be responsible for any such charges.

GOB Maps

GOB 'n' GOB includes an in-game editor, GOB Mapper, that you can use to create GOB Map beat maps to any MP3 format song you would like to allow play in rhythm with the song. You may distribute, share, and upload GOB Maps you create or that you receive from others, but you may only use GOB Maps with copies of music that you properly own or license, and you may not distribute GOB Maps with unauthorized copies of music to which they relate. LDG is not responsible for the content of GOB maps distributed by others.

Updates

LDG reserves the right to make changes to the game, including adding advertising or to charge for access to all or part of its functionality, at any time and for any reason. If we charge for access, we will make clear to you what the charge is and what it is for.

LDG may wish to update the game at some point in a manner that requires re-downloading the game. The app is currently available on Meta Quest Store. The requirements for the system (and for any additional systems we decide to extend the availability of the game to) may change, and you will need to download the updates if you want to keep using the game. LDG cannot promise that it will always update the game so that it works with the current operating system version that you have installed on your device.

LDG may also wish to stop providing the game, or stop providing active support or updates to the game, including security updates, and while we will attempt to give advance warning to our users, we may terminate use of it at any time without giving notice of termination to you.

We may also terminate your license if we discover your violation of the terms of this agreement, including the prohibition on reverse-engineering, or interfering or altering with gameplay, and upon termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the game, and (if needed) delete it from your device.

Warranty and Limitation of Liability

THIS GAME IS PROVIDED 'AS IS' AND ‘AS-AVAILABLE,’ WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED. LDG DISCLAIMS AND NEGATES ALL OTHER WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, QUALITY OF INFORMATION, OR TITLE/NON-INFRINGEMENT. FURTHER, LDG DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS CONCERNING THE ACCURACY, LIKELY RESULTS, OR RELIABILITY OF THE USE OF THE GAME. YOU EXPRESSLY AGREE AND ACKNOWLEDGE THAT USE OF THE GAME IS AT YOUR SOLE RISK, AND YOU AGREE THAT WE WILL NOT BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR YOUR USE OF THE SITE OR SERVICES. APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

In no event shall LDG be responsible for any damages, including without limitation direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with the Site or Services or use thereof or inability to use by any party, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if LDG, or representatives thereof, are advised of the possibility of such damages, losses or expenses.

Situational Awareness

Playing GOB 'n' GOB can distract you from your surrounding physical environment. Please pay attention to where you play, and only play in a safe environment. LDG is not responsible for any damage or harm from or to your environment when playing the game.

Applicable Law

These Terms of Use shall be governed in all respects by the substantive laws of the State of Nevada, without regard to its provisions relating to conflict of laws. You and LDG agree to submit to the personal and exclusive jurisdiction and venue of the state and federal courts located within Las Vegas, Nevada. The failure of LDG to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of the Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms and Conditions remain in full force and effect.

Changes to these Terms and Conditions

LDG may update our Terms and Conditions from time to time, and will request that you acknowledge such a new Terms and Conditions when we make any material changes to it.
